Notice is hereby given the Annual General Body Meeting of the Fort Oasis Apartment Owners Association (FOAOA)  for the financial year 2017-2018 will be held at the Banquet Hall of the Fort Oasis complex on Sunday 13th May 2018 at 10 AM.  FOAOA members who have cleared all maintenance dues from July 2016 are welcome to participate.
The Agenda will be as follows

  1. Report of the Executive Committee FOAOA, 2017-18 on all incidents and activities during the year 2017-2018
  2. Presentation of the FOAOA Accounts for the year 2017-2018
  3. Election of the Executive Committee for the year 2018-2019, if the number of nominations received is more than 24 
  4. Appointment of Auditors and fixing of their remuneration

Extraordinary General Body Meeting

  1. An EGBM will be held on 3rd December 2017, at 10:00 AM in the Banquet Hall
  2. Agenda is as follows :
    1. To review the situation arising out of the following :
      1. The OASIS complex is managed by Fort Oasis Maintenance Private Limited (FOMPL), a company wholly owned by the developer that collects maintenance charges from all residents and delivers all services.
      2. FOMPL has an understanding with FOAOA through which FOAOA Office bearers supervise the work of FOMPL and approve all expenditure of FOMPL
      3. Current FOAOA office bearers have collectively decided to relinquish the responsibility of supervising the task of FOMPL
      4. At an EC meeting of FOAOA called on 12th November even though a quorum was present, no EC member volunteered to take the responsibility of supervising FOMPL. So a decision was taken to call an EGM -- subject to a second meeting of the EC on 15th November.
      5. Even at the meeting on 15th November, no EC member volunteered to take the responsibility of supervising FOMPL
      6. The following nine owners and members of FOAOA have decided to voluntarily form a Management Committee to supervise the work of FOMPL
        1. Ajit Daga, BK Daga, Mahendra Sethia, Anil Baid, Prithwis Mukerjee, Sundip Gupta, Rabindra Agarwal, Ranajit Gupta, Manmal Chopra
    2. To ratify and approve the formation of the Management Committee
    3. To identify and include any other member who volunteers to be a part of the Management Committee and indicates his or her interest at the EGBM

Fort Oasis Newsletter September 2017

Introduction

It has been a while since we have had any formal communication from the FOAOA and so the Executive Committee felt that it is time to appraise our residents about what is happening at Oasis. Perhaps, newsletters like this should be more frequent but then again better late than never. In this newsletter we try give a quick view of the cash flow position and also a list of tasks that have been executed in the past couple of months. Even though this is a long mail, in your own interest, you should read this newsletter till the end.

First, owners and residents need to understand the model on which the Oasis residential complex is currently being run. There are two entities namely Fort Oasis Maintenance Private Limited ( FOMPL) and Fort Oasis Apartment Owners Association (FOAOA)

FOMPL is a Private Limited Company, that is wholly owned by the Promoter, Fort Group. FOMPL is the company that sends maintenance bills to residents, collects payments and is responsible for the maintenance of the complex. The Property Manager and staff of Property Management Office is a paid employee of FOMPL.

FOAOA is an association that some owners have voluntarily joined. All owners are invited but not everyone has responded to this invitation. The Executive Committee (EC) of the FOAOA is constituted through an election at the annual AGM of the FOAOA and consists of volunteers who have agreed to serve. They are not paid employees of either the Promoters or FOMPL. FOAOA is formally responsible only for the cultural activities like Holi, Diwali, Durga Puja and other events for which it collect funds from members. Payments to FOAOA are separate from payment to FOMPL and are kept in separate bank accounts.

Since FOMPL is a Private Limited company, and not a Co-operative society under the Cooperative Societies act it is liable to pay GST. Efforts to register FOAOA under the relevant Act and and then moving the billing process from FOMPL to FOAOA is one of the long term goals of the FOAOA.

FOAOA was created in 2013 to protect the interests of owners because it was felt that the Promoter and FOMPL was not discharging its responsibilities towards the owners. In particular, it was felt that Maintenance charges paid by owners was being diverted to other projects of the promoter. To prevent this, FOAOA petitioned and convinced the Promoter / FOMPL to create a special saving bank Account in Federal Bank that was (a) opened in the name of FOMPL and (b) has a signatory from FOAOA without whose signature no money can be spent.

This ensures that any money paid by owners to FOMPL into the Federal Bank Account after July 2016 is being spent only for Oasis maintenance. FOAOA has no visibility into the other accounts of FOMPL or of any transaction prior to July 2016 and outside the Federal Bank Account. Hence it cannot help with any dues or outstandings prior to July 2016. However after July 2016, FOAOA has been able to monitor and control the flow of money into and out of the Federal Bank account. The cash flow position for the past three months is shown here. This is not a statement of accounts of FOMPL as FOAOA has no visibility on the rest of the company -- including the sinking fund paid to the promoter and the interest that is supposed to accrue on the same.

Since direct CESC connection has not yet been provided to Towers, residents make electricity payments to the Promoters who then settle with CESC through an HDFC bank account.

Please note that a list of people who have outstanding dues is available in the Property Manager’s office and a list of people who have not paid any money since the FOAOA took over in July 2016 has been put up onl all noticeboards. Please read this and if possible convince these residents to make their payments. FOAOA has appointed one person to chase payments but this is not enough.

Major Tasks

The cash received by FOMPL into the Federal Bank account is used for ESSENTIAL monthly expenditures including but not limited to (1) Security services, (2) Fire fighting Services (3)Housekeeping Services, (4) Garbage Clearance Services, (5) Gardening Services, (6)Common Area electricity and (7) Maintenance of critical equipment like Lifts, Pumps, Water Filter Diesel Generator sets. Without these services, residing in Oasis will not be possible.

Please note that a simple study of the cash flow position will show that FOMPL does not have any surplus funds for repairs to individual flats. Flat owners who have problems are earnestly requested to contact the promoters and their project office for all complaints. While FOMPL would like to help, it is in no position to do so.

There was a fire alarm at block 5 at around 11.30 pm. The security alerted everybody about an emerging smell of fire. The in-house maintenance staffs were alerted, and necessary measures were adopted in a war like scenario, as applicable to this sought of an emergency. At about 12-30 am, the electrician detected sparks emerging from an adopter socket connecting the Airtel dish tv junction. The connectivity was defused and any recurrence was averted.

Threat to the Peace of Oasis

On the first anniversary of Sep 19, 2016 act of vandalism in our Oasis of peace, the question which lurks behind our mind is whether the worst over or will peace return to our society. All who were our neighbors attacked us mercilessly venting fire -- but did they have any hidden agenda or was it a show of aggression? With the advancement of education and advent of new technologies, humanity all over the world has changed. Instead of becoming cultured it has become crude. Humans delight in killing human for religion, humans kill humans to save animals, humans kill humans for chauvinism. Hatred and bigotry have attained draconian strength. Our patience has turned thin. Every one desires to reach top by crushing others and does not hesitate even when his opponent is revealed to be his loved one.

Not only animosity is outside our housing complex but it is brewing within us too. Residents to do not miss single opportunity to show their annoyance on neighbors residing within the complex. Letters pop up showing dissents. False facts are spread to plant dissension between Towers and Blocks. Comparison of Towers and Blocks as India and Pakistan divided by imaginary line of control is common. Once this dissension takes root it will become difficult to weed it out.

Arrogance and antagonism of outside world can be tamed with support of outside people like police and politicians but once the internal internecine sprouts its ugly head then the existence of peace in Oasis will become uncertain. Let’s make a promise this Durga Puja, that we will not let the peace of Oasis fade away and will not encourage any instigation to divide our society.

Looking Forward

The Executive Committee of the FOAOA is trying its level best to improve the quality of service to residents but is hampered by a severe lack of participation from Owners. It is earnestly requested that more owners, join the FOAOA, participate in FOAOA EC elections, and help serve the committee in its efforts. Currently, indifference to if not defiance of the FOAOA and its effort to improve the complex is the biggest cause of concern. Please understand that it is the FOAOA and the FOAOA alone that has any interest in the welfare of the complex where FOAOA members have invested their hard-cash. Promoter has got his money and has no further interest. FOMPL staff are only interested in their monthly salary, nothing more. But it is the FOAOA membership and the FOAOA EC that has a long term interest in the welfare of this complex. Please join the FOAOA, participate in the EC and help protect your own investment in Oasis.
